1. Agreement and eligibility
These Terms of Service govern your access to and use of products and services provided by DeThink AI, LLC. “DeThink AI, LLC,” “we,” and “us” refer to the entity that operates the service. By creating an account, purchasing credits, downloading an application, or otherwise using the service, you agree to these terms.
You must be legally able to enter into a binding agreement and be at least 18 years old, or the age of majority where you live. If you use services provided by DeThink AI, LLC for an organization, you confirm that you have authority to bind that organization.
2. The service
DeThink AI, LLC provides a workspace for interacting with AI models, creating and analyzing content, working with files, conducting research, and using other supported tools. Features, model availability, limits, and supported platforms may change as the service develops.
Some features are provided as previews, experiments, or beta releases. They may be less reliable, may change without notice, and may be discontinued.
3. Accounts and security
You are responsible for activity performed through your account unless it results from a security failure attributable to DeThink AI, LLC.
- Provide accurate account information and keep it current.
- Protect your password, access tokens, devices, and other credentials.
- Do not share an account in a way that bypasses plan or usage limits.
- Tell us promptly at support@dethink.ai if you suspect unauthorized access.
4. Credits, plans, billing, and taxes
Paid features may be offered through subscriptions, prepaid credits, usage-based charges, or other plans shown at checkout. Prices, included credits, model rates, and plan limits are presented before purchase and may be updated prospectively.
Credits are a limited, non-transferable license to access eligible service features. They are not money, stored value, or property, have no cash value, and cannot be resold. Credits may expire only when an expiration period is disclosed at purchase or required by law.
Except where required by law or expressly stated at purchase, completed purchases are non-refundable. You are responsible for applicable taxes. Payment processing may be handled by third-party payment providers under their own terms.
5. Your content
You retain ownership of prompts, files, instructions, and other content you submit to the service (“Input”). As between you and DeThink AI, LLC, and to the extent permitted by law, you own the output generated for you (“Output”). You are responsible for both Input and your use of Output.
You grant DeThink AI, LLC a limited license to host, copy, process, transmit, and display your content only as needed to provide, secure, maintain, and improve the service; comply with law; and enforce these terms. This license ends when the content is deleted from our systems, subject to normal backups, legal obligations, and permitted retention.
You must have all rights and permissions needed to submit your content. Do not submit confidential, regulated, or sensitive information unless you are authorized to do so and the service is appropriate for that information.
6. AI output and professional decisions
AI systems generate probabilistic results. Output may be incorrect, outdated, offensive, incomplete, or similar to content generated for other users. DeThink AI, LLC does not guarantee factual accuracy, uniqueness, non-infringement, or fitness for a particular purpose.
Do not rely on Output as a substitute for qualified professional advice or human review in medical, legal, financial, employment, safety-critical, or other high-impact decisions. You are responsible for evaluating Output and using appropriate review, testing, citations, and safeguards.
7. Acceptable use
We may investigate suspected violations and restrict or suspend access when reasonably necessary to protect users, the service, third parties, or the public.
- Do not violate law, infringe rights, or facilitate fraud, abuse, harassment, exploitation, or deception.
- Do not create or distribute malware, credential theft, destructive code, or instructions intended to cause unauthorized harm.
- Do not attempt to bypass safeguards, usage limits, access controls, or security measures.
- Do not probe, scan, reverse engineer, scrape, resell, or overload the service except where applicable law expressly permits it.
- Do not impersonate others or misrepresent AI-generated material in a way that is unlawful or materially deceptive.
8. Third-party models and services
DeThink AI, LLC may route requests to third-party model providers, search services, infrastructure providers, payment processors, and integrations. Their systems may process your content to fulfill your request. Availability, behavior, and output are partly controlled by those providers.
Third-party services may have additional terms or policies. DeThink AI, LLC is not responsible for third-party products, external links, or changes made by those providers, except to the extent required by law.
9. DeThink AI, LLC intellectual property
The service, software, branding, interfaces, documentation, and related technology are owned by DeThink AI, LLC or its licensors. These terms give you a limited, personal, revocable, non-exclusive, non-transferable right to use the service as intended. They do not transfer ownership of DeThink AI, LLC technology or trademarks.
If you provide feedback, you allow us to use it without restriction or compensation, provided we do not identify you publicly without permission.
10. Suspension and termination
You may stop using the service at any time. We may suspend or terminate access if you materially breach these terms, create security or legal risk, fail to pay amounts due, or use the service in a way that could harm DeThink AI, LLC or others. Where practical, we will provide notice and an opportunity to remedy the issue.
Sections that by their nature should survive termination—including payment obligations, ownership, disclaimers, limitations of liability, and dispute terms—will continue to apply.
11. Disclaimers
To the maximum extent permitted by law, the service is provided “as is” and “as available.” DeThink AI, LLC disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not promise that content will be preserved without loss or that every model or feature will remain available.
Nothing in these terms excludes warranties or rights that cannot legally be excluded.
12. Limitation of liability
To the maximum extent permitted by law, DeThink AI, LLC and its affiliates, officers, employees, licensors, and suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunities.
Our total liability arising out of or relating to the service will not exceed the greater of the amount you paid DeThink AI, LLC during the 12 months before the event giving rise to the claim or USD 100. These limits do not apply where prohibited by law or to liability that cannot legally be limited.
13. Indemnity
If you use the service for a business, you will defend and indemnify DeThink AI, LLC from third-party claims arising from your unlawful use of the service, your content, or your material breach of these terms, to the extent permitted by law.
14. Export and sanctions compliance
You may not use or access the service in violation of export controls, sanctions, or trade laws. You represent that you are not prohibited from receiving the service under applicable law.
15. Changes and general terms
We may update these terms to reflect changes to the service, law, safety practices, or business operations. We will post the updated version and revise the effective date. If a change materially reduces your rights, we will provide reasonable notice when required. Continued use after the effective date means you accept the updated terms.
If any provision is unenforceable, the remaining provisions continue in effect. A failure to enforce a provision is not a waiver. You may not assign these terms without our consent; we may assign them as part of a merger, financing, reorganization, or transfer of the service. Applicable mandatory law and the courts with lawful jurisdiction govern disputes between you and DeThink AI, LLC.
